PAYROLL CARD STATEMENT OF FEES AND DISCLOSURE & AGREEMENT OF TERMS AND CONDITIONS

This enclosed Statement of Fees and Disclosure & Agreement of Terms and Conditions is part of the contract for your Payroll Card account with us. Please read this document in full.

Payroll Card Statement of Fees

We are pleased to provide you with this Statement of Fees. We may change this statement of fees from time to time without notice or as otherwise provided by law.

Getting Started

  • Account opening and initial Payroll Card – $0. There is no charge to open a Payroll Card account.

Monthly Usage

  • Monthly fee – $0. SchoolsFirst FCU does not charge a monthly maintenance fee.

Adding Money

  • Direct deposit – $0. SchoolsFirst FCU does not charge a fee for direct deposit.
  • Cash reload – N/A. SchoolsFirst FCU does not offer this service.

Withdrawing Money

  • ATM withdrawal at SchoolsFirst FCU and CO-OP Network locations – $0. Find SchoolsFirst FCU and CO-OP ATM locations near you.
  • ATM withdrawal at non-SchoolsFirst FCU and non-CO-OP Network locations – $2. This is our fee. Non-CO-OP ATMs refer to ATMs outside of the CO-OP ATM network. You may also be charged a fee by the ATM operator, even if you do not complete a transaction.
  • Merchant debit transactions, Signature or PIN – $0. SchoolsFirst FCU does not charge for signature based or PIN based point of sale purchases. Terminal operator fee may apply.
  • In-branch cash withdrawal – $0. Payroll cardholders may make one (1) over-the-counter cash withdrawal per pay period at a SchoolsFirst FCU branch location. Find branch locations near you.
  • Cashier's check payable to Payroll Cardholder – $5. Payroll cardholders may obtain cashier's checks payable to the Payroll Cardholder only. Each pay period, we will waive the fee for your first cashier's check that pay period. Additional cashier's checks may be purchased for $5 each.

Information

  • Customer Service (live or automated telephone assistance) – $0. There is no fee for calling SchoolsFirst FCU's automated or live telephone line, including balance inquiries.
  • Balance inquiry at SchoolsFirst FCU and CO-OP network ATMs – $0. SchoolsFirst FCU does not charge a fee for balance inquiries.
  • Balance inquiry at non-SchoolsFirst FCU and non-CO-OP network ATM locations – $0. SchoolsFirst FCU does not charge a fee for balance inquiries. You may be charged a fee by the ATM operator.

Using Your Card Outside the United States

  • Mastercard® cross-border fee – up to 2%. For a purchase or ATM withdrawal outside the U.S., a cross-border fee of up to 1.8% of the transaction amount will be assessed. If the merchant settles in acurrency other than U.S. dollars, an additional currency conversion fee of 0.20% of the transaction amount will be assessed for performing the conversion.
  • ATM withdrawal at international ATM locations – $2. This is a SchoolsFirst FCU fee. You may also be charged a fee by the ATM operator, even if you do not complete a transaction.
  • Balance inquiry at international ATM locations – $0. SchoolsFirst FCU does not charge a fee for balance inquiries. You may be charged a fee by the ATM operator, even if you do not complete a transaction.

Other

  • Account Inactivity – $0. SchoolsFirst FCU does not charge an inactivity fee.
  • Online Banking – $0. SchoolsFirst FCU does not charge to use Online Banking.
  • eStatements – $0. SchoolsFirst FCU does not charge for providing eStatements.
  • eStatement copies – $0. SchoolsFirst FCU does not charge for providing eStatement copies.
  • Payroll Card replacement (per card) – $5. This fee applies for each replacement card, unless it is for a stolen or compromised card, or for a card blocked due to fraudulent transactions.
  • Rush Payroll Card replacement (per card) – $20. This fee applies to the rush delivery of a replacement card.
  • Legal processing (levies, garnishments, etc.) – $25. A legal processing fee may be charged by SchoolsFirst FCU to process and comply with legal enforcements.

Your funds are not NCUA insured. In the event that SchoolsFirst FCU fails and is forced into closure, you are not protected by NCUA deposit insurance and could lose some or all of your money.

SchoolsFirst FCU Payroll Card does not offer an overdraft or credit feature.

Payroll Card Disclosure & Agreement of Terms and Conditions

This Disclosure & Agreement is presented for your information. Please read it carefully as it pertains to your SchoolsFirst FCU Payroll Card, and is accurate as of the date shown on the cover. We may change terms or amend this Disclosure & Agreement from time to time without notice or as otherwise provided by law. For the purposes of this Disclosure & Agreement, "we", "us", "our", "SchoolsFirst FCU", and "Credit Union" refer to SchoolsFirst FCU, and "you" and "your" refer to the Payroll Cardholder(s). "Payroll Card", "Card", and "Account" refer to the SchoolsFirst FCU Payroll Card, and "Disclosure & Agreement", "Terms and Conditions", "Account Agreement", and "Agreement" as applicable, refers to this Disclosure & Agreement of Terms and Conditions.

The SchoolsFirst FCU Payroll Card is offered to you through your employer. Upon approval from your employer and you, a Payroll Card will be issued to you. The SchoolsFirst FCU Payroll Card is a debit card which is used to access wages, salary, or other compensation your employer deposits into a Payroll Card Account in your name held at the Credit Union. The Credit Union does not pay any dividends or interest on the funds associated to Payroll Card Accounts. You must sign the Card before using it. By receiving and using your SchoolsFirst FCU Payroll Card, you agree to be bound by these Terms and Conditions. You are not entitled to any rights or benefits given to our Credit Union Members unless such rights or benefits are contained in the Agreement. The Credit Union may refuse to issue a Payroll Card to anyone for any reason, to the extent permitted by law. The Credit Union reserves the right to restrict services and limit access for Payroll Cardholders who commit financial misconduct, cause a loss to the Credit Union, engage in suspicious or illegal activities, or exhibit highly disruptive or abusive behavior.

Your employer will notify you of each deposit of compensation into your Account.

Business Days

For purposes of these Payroll Card disclosures, our business days are Monday through Friday, excluding federal holidays.

Types of Available Transactions

SchoolsFirst FCU provides Payroll Cardholders the following services to access their account at the Credit Union.

  • Automatic Teller Machine (ATM) withdrawals.
  • Point-of-sale purchases.
  • Merchant debit transactions.
  • Over the counter cash withdrawals.
  • Cashier's check (payable only to Payroll Cardholder).
  • Balance inquiries at ATMs.

Cash Transactions

All cash transactions are final. If you need cash in the amount of $3,000 or more from us, we may require a 48-hour advance notice. We are required by the Bank Secrecy Act to file certain reports and follow specific customer identification procedures in cases of large currency transactions.

Cashier's Checks

Stop payments on cashier's checks are not permitted. In the event that a cashier's check is lost, stolen, or destroyed, please contact us for procedures to obtain reimbursement or to have the cashier's check reissued. There may be a delay of up to 90 calendar days before the funds may be reimbursed or the check reissued.

Transaction Limitations

This Card has certain transaction limitations:

  • Daily ATM withdrawal limit — lower of available balance or $500.
  • Daily PIN based point of sale purchase limit — lower of available balance or $2,500.
  • Merchant debit transaction — signature or PIN limit — lower of available balance or $2,500.
  • Branch cash withdrawal limit — one over the counter cash withdrawal per pay period.
  • Branch cashier’s check withdrawal limit — one cashier’s check per pay period at no charge. Cashier’s checks must be payable to the payroll Cardholder only. Additional cashier’s checks may be purchased for $5.00 each.
  • Restrictions to add money to your Card — only your employer can add funds to your Card. Cardholders may not add funds to Card.
  • Restrictions on stop payments — stop payments are not permitted on Card transactions.

Access Devices

Payroll Cards are an access device, and Personal Identification Numbers (PIN), access codes, and passwords are collectively referred to by us as "access codes." By requesting, signing or using (or authorizing another person to sign or use) any Card, device, or access code, you and the other person(s) agree to use the Card, device, or access codes in accordance with the following terms and conditions.

Confidentiality of Access Codes

You agree to hold your access code in strict confidence and you will notify us immediately if your Card or access code is lost or stolen. As a precaution, it is recommended that you memorize your access code and do not write it down. Furthermore, you should 1) not write your access code on your access device or any material carried with your access device; 2) never let anyone else use your access device; 3) never tell anyone your access code; 4) never let anyone watch you use your access device or access code.

Access to Accounts

Any person who receives a duplicate access device (as requested by you) or who is permitted to use your access device or access code will have access to your entire Payroll Card Account, including the ability to withdraw funds from your Account or make purchases. We refer to such person as an authorized user and you agree that an authorized user may withdraw funds from your Account or make purchases with the access device.

Transaction Authorization

By using your access device in conjunction with your access code, you authorize the Credit Union to provide Account balance information, and to make withdrawals from your Payroll Card Account with the Credit Union in accordance with commands entered.

Contact for Lost or Stolen Card, or PIN or Misuse of Check Information

If you believe your Payroll Card or access code has been lost or stolen, that someone withdrew or may withdraw money from your Account without your permission, call us at (855) 312-0029, or write us at SchoolsFirst FCU, ATTN: Security and Fraud Management, P.O. Box 11547, Santa Ana, CA 92711-1547.

Liability for Unauthorized Use

"Unauthorized use" means the use of your Payroll Card or access code by a person, other than you, who does not have actual, implied, or apparent authority for such use, and from which use you receive no benefit.

Tell us immediately if you believe your Card or PIN has been lost or stolen. Telephoning is the best way of keeping your possible losses down. You could lose all the money on your Card. If you tell us within 2 business days after you learn of the loss or theft of your Card, you can lose no more than $50 if someone used your Card without permission. If you do not tell us within 2 business days after you learn of the loss or theft of your Card, and we can prove we could have stopped someone from using your Card without your permission if you had told us, you could lose as much as $500.

Also, if your activity shows transfers that you did not make, including those made by Card, access code or other means, tell us at once. If you do not tell us within 120 days after the earlier of the date you electronically access your account (if the unauthorized transfer could be viewed in your electronic history) or the date we sent the FIRST written history on which the unauthorized transfer appeared (but in any event within 120 days after the transaction allegedly in error was credited or debited to your account), you may not get back any money you lost after the 120 day period if we can prove that we could have stopped someone from taking the money if you had told us in time. If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time periods.

If you authorize someone else to use your access code or Card, you are responsible for all transactions which that person initiates at any time, even if the amount of the transaction or number of transactions exceeds what you authorized.

Mastercard Zero-Liability for Unauthorized Use

Your liability for unauthorized use of your Card when it is used for a merchant debit transaction and PIN-based ATM/Point-of-Sale (POS) transactions, will not exceed $0 if the following conditions have been met:

  • You report the loss or theft of your Card within 24 hours of discovering it lost or stolen; and
  • You can demonstrate that you have executed reasonable care in safeguarding your Card from risk of loss or theft; and
  • Your Account is in good standing.

If these conditions have not been met, the terms included in the section above, Liability for Unauthorized Use may apply.

Right to Receive Documentation

You may not get a receipt every time you use your Payroll Card at other ATMs or POS terminals for transactions of $15 or less. You can get a receipt at the time you conduct a transaction from your Account using one of our ATMs. You can call us at (855) 312-0029 to find out whether or not deposits have been made. If you enroll in and maintain eStatements, you will receive an eStatement monthly reflecting your transaction history. We do not offer auto-generated periodic statements through regular mail for Payroll Card Accounts, however, you may access your eStatement and history of Account transactions via the Credit Union's Online Banking website.

You may obtain information about the amount of money you have remaining in your Payroll Card Account by calling (855) 312-1547. This information, along with a 12-month history of account transactions, is also available online at schoolsfirstfcu.org.

You also have the right to obtain at least 24 months of written history of account transactions by calling (855) 312-0029, or by writing us at SchoolsFirst FCU, ATTN: Debit Card Services, P.O. Box 11547, Santa Ana, CA 92711-1547.

You agree to immediately review each statement or Account history made available or provided to you to ensure that each and every transaction has been authorized by you. Your failure to promptly report any allegedly unauthorized transaction may result in future allegedly unauthorized transactions to be considered authorized.

Liability for Failure to Make Transfers

If we do not complete a transfer to or from your Account on time or in the correct amount according to our Agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will NOT be liable:
  • If, through no fault of ours, you do not have enough money in your Account to make the transfer.
  • If the ATM where you are making the transfer does not have enough cash.
  • If the terminal was not working properly and you knew about the breakdown when you started the transfer.
  • If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken.
  • We received incorrect or incomplete information from you or from third parties (e.g., the U.S. Treasury, an automated clearing house, or a terminal owner).
  • The funds in your Account are subject to an uncollected funds hold, legal process, or other circumstances restricting such transaction or payment.
  • Your access code you provide is incorrect or incomplete, or the access device or access code has been reported lost or stolen, has expired, is damaged so that the mechanical device cannot read the encoding strip, is inactive due to non-use, is retained by us due to your misuse or suspected fraudulent activities, or your access code has been repeatedly entered incorrectly.
  • Our failure to complete the transaction or the placement of a block on your Account is done to protect the security of your Account and/or the electronic terminal system.
  • Any transaction is prohibited by law, regulation, court order, or illegal activity.
  • There may be other exceptions stated in our Agreement with you.

Provided that none of the foregoing exceptions to our service performance obligations are applicable, if we cause an incorrect amount of funds to be debited from your Account, or caused funds from your Account to be paid to a person or entity which does not comply with your payment instructions, we shall be responsible for returning the improperly transferred funds to your Account and for directing to the proper recipient any previously misdirected payments or transfers.

THE FOREGOING SHALL CONSTITUTE OUR ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY. IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS (EVEN IF ADVISED OF THE POSSIBILITY THEREOF) ARISING IN ANY WAY OUT OF THE ACCOUNT.

ATM Fees

When you use an ATM not owned by us, you may be charged a fee by the ATM operator or any network used, and you may be charged a fee for a balance inquiry even if you do not complete a fund transfer.

In Case of Errors or Questions about your Payroll Card Account

Call at (855) 312-0029 or write us at SchoolsFirst FCU, P. O. Box 11547, Santa Ana, CA 92711-1547 as soon as you can if you think an error has occurred on your statement, account transaction history or receipt, or if you need more information about a transfer listed on your statement, account transaction history or receipt. We must hear from you no later than 120 days from the date the problem or error was credited or debited to your account. You may request a written history of your transactions at any time by calling us at (855) 312-0029 or writing us at SchoolsFirst FCU, P.O. Box 11547, Santa Ana, CA 92711-1547.

  1. Tell us your name and Payroll Card account number.
  2. Describe the error or transfer you are unsure about, and explain why you believe there is an error or why you need more information.
  3. Tell us the dollar amount of the suspected error and the date it took place.

If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days.

We will determine whether an error occurred within 10 business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will credit your account within 10 business days for the amount you think is in error, so that you will have the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not credit your account.

For errors involving new accounts, point-of-sale, or foreign-initiated transactions, we may take up to 90 days to investigate your complaint or question. For new accounts, we may take up to 20 business days to credit your account for the amount you think is in error. An account is considered a new account for 30 days after the first deposit is made.

We will tell you the results within three business days after completing our investigation. If we decide that there was no error, we will send you a written explanation.

You may ask for copies of the documents that we used in our investigation.

Credit Union Liability

The Credit Union has no responsibility to you in the event your employer delays providing or fails to provide funds. You agree that only your employer may transfer funds to your Payroll Card Account and you will not authorize any third party to transfer funds to your Card. Your employer may retain the right to deduct funds from your Payroll Card in order to adjust for errors (including but not limited to overpayment) or for other reasons in accordance with applicable law. You agree that disputes about your wages, salary, and other deposits or deductions to or from your Payroll Card will not involve the Credit Union, but will be resolved between your employer and you.

Unclaimed Funds

California's Unclaimed Property Law requires us to report and deliver your funds to the appropriate state if there has been no activity on your Account for more than one year after becoming payable. To avoid having your funds escheated to the State, you may:

  • Make a withdrawal.
  • Correspond with us about your Account in writing.
  • Respond as instructed to a notice of inactivity or dormancy.

Confidentiality

We will disclose information to third parties about your account or the transfers you make only when one of the following conditions exist:

  • When necessary to complete a transaction requested by you.
  • In order to verify the existence and status of your account, such as for a retail merchant or credit reporting agency.
  • In order to comply with government agencies, legal process, or any court orders.
  • If you give us written permission.

Termination

Payroll Cards are the property of the Credit Union and you agree to surrender the Card(s) issued to you to the Credit Union promptly upon demand. We may restrict your ability to make ATM withdrawals or revoke the Payroll Card at any time without prior notice or liability. You may terminate these Terms and Conditions at any time by returning your Payroll Card to the Credit Union. Termination, whether by you, your employer or the Credit Union, shall not affect prior transactions or obligations relating to your Payroll Card Account existing at the time of termination. Upon termination, the Credit Union will arrange to transfer any remaining funds associated with the Card to you.

Unlawful Use

You warrant and agree that you will not use the Payroll Card Account or services to make or facilitate any illegal transactions as determined by applicable law or for the purchase of any goods or services on the Internet that involve online gambling of any sort and that any such use, including any such authorized use, will constitute an event of default under this Agreement. Prohibited activity and transactions include, but are not limited to, any quasi-cash or online gambling transaction, electronic commerce gambling transaction conducted over an open network, and any betting transaction including the purchase of lottery tickets or casino gaming chips or off-track betting or wagering. We may deny authorization of any transactions identified as gambling. However, in the event that a prohibited or illegal transaction described in this paragraph is approved and processed, you will still be responsible for such charges. You agree that the Credit Union will not have any liability, responsibility, or culpability whatsoever for any such use by you or any authorized users. You further agree to indemnify and hold the Credit Union harmless from any lawsuits, liability, damages or adverse action of any kind that results directly or indirectly from such illegal or prohibited use.

Severability

In the event that any portion of this Agreement is held by a court to be invalid or unenforceable for any reason, the remainder of this Agreement shall not be invalid or unenforceable and will continue in full force and effect. All headings are intended for reference only and are not to be construed as part of the Agreement.

AGREEMENT TO ARBITRATE CLAIMS; CHOICE OF FORUM; JURY TRIAL WAIVER

BY OBTAINING ANY PRODUCT OR SERVICE FROM SCHOOLSFIRST FEDERAL CREDIT UNION, YOU AGREE THAT ANY DISPUTE RELATED TO THOSE PRODUCTS OR SERVICES (EXCEPT DISPUTES SUBJECT TO SMALL CLAIMS COURT JURISDICTION, OR DISPUTES FROM WHICH CONSUMERS ARE EXEMPT FROM ARBITRATION UNDER APPLICABLE LAW) WILL BE RESOLVED BY BINDING ARBITRATION. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT AND ASSERT YOUR RIGHTS OR DEFENSES BEFORE A JUDGE OR A JURY IN A COURT OF LAW. YOU ALSO GIVE UP YOUR RIGHT TO ASSERT CLAIMS ON A CLASS OR REPRESENTATIVE BASIS, AS ALLOWED BY YOUR STATE'S LAWS. YOU ARE ENTITLED TO A FAIR HEARING BEFORE A NEUTRAL ARBITRATOR. THE ARBITRATOR'S RULING CAN BE ENTERED AS A JUDGMENT IN COURT AND IS SUBJECT TO APPEAL ONLY UNDER VERY LIMITED CIRCUMSTANCES.

Please review the terms below:

  1. THE ARBITRATION PROVIDED FOR BY THIS AGREEMENT WILL BE ADMINISTERED BY JAMS (www.jamsadr.com). THE ARBITRATION WILL TAKE PLACE EITHER REMOTELY OR AT THE JAMS OFFICE NEAREST TO YOUR COUNTY OF RESIDENCE.NEITHER THE CREDIT UNION NOR THIRD PARTIES COLLECTING DEBTS ON OUR BEHALF WILL INITIATE ARBITRATION TO COLLECT A CONSUMER DEBT, BUT THE CREDIT UNION RESERVES THE RIGHT TO ARBITRATE ALL OTHER DISPUTES WITH YOU. YOU CAN ELECT TO REQUIRE THE CREDIT UNION OR OUR THIRD-PARTY COLLECTION AGENCIES TO SUBMIT TO ARBITRATION OF A DEBT COLLECTION ACTION WE OR THEY INITIATED AGAINST YOU IN COURT.THIS ARBITRATION AGREEMENT WILL APPLY NOT ONLY TO SCHOOLSFIRST BUT ALSO ANY THIRD PARTIES WHO PROVIDE SERVICES ON BEHALF OF SCHOOLSFIRST.THIS ARBITRATION AGREEMENT WILL REMAIN IN EFFECT EVEN IF YOU TERMINATE THE PRODUCT(S) OR SERVICE(S) FROM THE CREDIT UNION AND PAY OFF ALL OF THE OBLIGATIONS YOU INCURRED. THE TERM “DISPUTE” INCLUDES ANY CONTROVERSY OR DISAGREEMENT RELATED TO THE PRODUCT OR SERVICE, INCLUDING BUT NOT LIMITED TO (A) CLAIMS THAT THE CREDIT UNION FAILED TO COMPLY WITH APPLICABLE LAW, (B) CLAIMS THAT YOU OR THE CREDIT UNION BREACHED ANY WRITTEN OR ORAL AGREEMENT, (C) CLAIMS THAT THE CREDIT UNION INJURED OR DAMAGED YOU, OR (D) CLAIMS RELATED TO THE INTERPRETATION OR ENFORCEABILITY OF THIS ARBITRATION AGREEMENT. QUESTIONS ABOUT WHETHER A DISPUTE IS SUBJECT TO ARBITRATION SHALL BE INTERPRETED AS BROADLY AS THE LAW ALLOWS AND BE DECIDED BY THE ARBITRATOR. IF EITHER YOU OR THE CREDIT UNION REFUSES TO SUBMIT A DISPUTE TO ARBITRATION UPON DEMAND BY THE OTHER PARTY, THE PARTY THAT SEEKS ENFORCEMENT OF THIS ARBITRATION PROVISION AGAINST THE REFUSING PARTY WILL, IF SUCCESSFUL, RECOVER ITS COSTS OF DOING SO FROM THE OTHER PARTY, ASSUMING THIS IS ALLOWED BY STATE LAW AND IF SO, TO THE MAXIMUM EXTENT ALLOWED BY STATE LAW. THIS ARBITRATION AGREEMENT IS GOVERNED BY THE FEDERAL ARBITRATION ACT.
  2. DISPUTES IN WHICH THE DOLLAR AMOUNT IN CONTROVERSY DOES NOT EXCEED THE SMALL CLAIMS JURISDICTIONAL LIMIT MAY BE BROUGHT BY EITHER YOU OR THE CREDIT UNION IN THE SMALL CLAIMS COURT IN YOUR COUNTY OF RESIDENCE.
  3. THIS AGREEMENT DOES NOT PROHIBIT YOU OR THE CREDIT UNION FROM EXERCISING ANY LAWFUL RIGHTS OR USING OTHER AVAILABLE REMEDIES TO PRESERVE, FORECLOSE, OR OBTAIN POSSESSION OF REAL OR PERSONAL PROPERTY; EXERCISE LAWFUL SELF-HELP REMEDIES, INCLUDING SETOFF AND REPOSSESSION RIGHTS; OR OBTAIN PROVISIONAL OR ANCILLARY REMEDIES SUCH AS INJUNCTIVE RELIEF, ATTACHMENT, GARNISHMENT, OR THE APPOINTMENT OF A RECEIVER BY A COURT OF COMPETENT JURISDICTION.
  4. THE STATUTE OF LIMITATIONS THAT WOULD APPLY TO ANY DISPUTE SUBJECT TO THIS AGREEMENT WILL ALSO APPLY TO THE ARBITRATION PROCEEDINGS.
  5. ALL CLAIMS WILL BE ARBITRATED ON AN INDIVIDUAL RATHER THAN A CLASS OR REPRESENTATIVE BASIS. IF THE PRODUCT OR SERVICE HAS MULTIPLE OBLIGORS, A SINGLE PROCEEDING MAY BE MAINTAINED BY OR AGAINST ALL OF THOSE PARTIES TO THE PRODUCT OR SERVICE.
  6. ALL COSTS OF ARBITRATION ASSESSED BY JAMS, INCLUDING FEES CHARGED BY THE ARBITRATOR, WILL BE BORNE BY THE CREDIT UNION, EXCEPT WHERE ALLOWED BY STATE LAW YOU WILL PAY JAMS'S THEN-CURRENT FEE FOR CONSUMER-INITIATED ARBITRATIONS.
  7. ALL CLAIMS WILL BE HEARD BY A SINGLE ARBITRATOR KNOWLEDGEABLE IN THE SUBJECT AREA OF THE DISPUTE WHO IS EITHER A RETIRED STATE OR FEDERAL COURT JUDGE OR AN ATTORNEY WITH AT LEAST TEN YEARS OF RELEVANT PRACTICE EXPERIENCE.
  8. THE ARBTIRATION PROCEEDINGS WILL BE GOVERNED BY THE JAMS CONSUMER ARBITRATION RULES. THE ARBITRATOR WILL APPLY THE APPLICABLE SUBSTANTIVE LAW.
  9. EACH PARTY WILL HAVE THE SAME REMEDIES AVAILABLE IN ARBITRATION AS IT WOULD HAVE AVAILABLE IF THE DISPUTE WERE HEARD IN COURT.
  10. THE ARBITRATOR SHALL ISSUE A WRITTEN STATEMENT OF DECISION SETTING FORTH THEIR RULING ON EACH CLAIM. THE STATEMENT OF DECISION WILL INCLUDE THE FINDINGS OF FACT AND CONCLUSIONS OF LAW ON WHICH THE RULING ON EACH CLAIM IS BASED.
  11. ABSENT CLEAR ABUSE OF DISCRETION BY THE ARBITRATOR IN MAKING FINDINGS OF FACTS OR CONCLUSIONS OF LAW, THE ARBITRATOR'S DECISION WILL BE FINAL, BINDING, AND NOT SUBJECT TO APPEAL. THE ARBITRATOR'S DECISION MAY BE ENTERED AS A JUDGMENT IN A COURT OF COMPETENT JURISDICTION.
  12. THIS AGREEMENT DOES NOT APPLY TO LOANS SECURED BY REAL ESTATE OR SUBJECT TO THE MILITARY LENDING ACT.
  13. IF A COURT OR ARBITRATOR HOLDS THAT ANY PROVISION OF THIS AGREEMENT TO ARBITRATE CLAIMS IS ILLEGAL, UNENFORCEABLE, OR INVALID FOR ANY REASON, THE VALIDITY AND ENFORCEABILITY OF THE REMAINING PROVISIONS OF THIS AGREEMENT SHALL NOT BE AFFECTED, PROVIDED, HOWEVER THAT THIS CLAUSE SHALL NOT BE APPLIED TO DEFEAT THE PRIMARY INTENT OF THE PARTIES TO RESOLVE DISPUTES BY BINDING ARBITRATION.

Governing Laws

This Agreement is governed by the Bylaws of the Credit Union, federal laws and regulations, the laws (including applicable principles of contract law) and regulations of the state of California, and local clearinghouse rules, as amended from time to time.

Non-waiver

The failure by one party to require performance of any provision shall not affect that party's right to require performance at any time thereafter, nor shall a waiver of any breach or default of this Agreement constitute a waiver of any subsequent breach or default or a waiver of the provision itself.

Telephone Monitoring

In the regular course of our business, we may monitor and record phone conversations made or received by our employees. You agree that we will have such right with respect to all phone conversations between you and our employees, whether initiated by you or any of our employees.

Cell Phones

By providing us with your cell phone number, you are providing us with express consent to contact you at this number, including through the use of an automated dialing system.

Funds Availability

Each pay period or as otherwise agreed your employer is responsible for transferring funds to the account associated with your Payroll Card held with the Credit Union. These funds are available for you to withdrawal on the later of: (1) your payday (as of the time we are open for business) or (2) the time when we receive the funds from your employer. If either day, however, is a not a business day for us, the funds will be available to you by the opening of our next business day. For purposes of these Terms and Conditions, every day is a business day, except Saturdays, Sundays, and federal holidays.

Uninsured Account

Your funds are not NCUA insured. In the event that SchoolsFirst FCU fails and is forced into closure, you are not protected by NCUA deposit insurance and could lose some or all of your money.

Your Right to Stop Payment

You do not have the right to stop payment on any transactions made with your Card. You may stop deposits to the Card by contacting your employer.

Change in Terms

We may change the terms and charges for the services described in this Agreement and may amend, modify, add to, or delete from this Agreement from time to time. To the extent required by applicable law, you will receive written notice of the change in terms at least 21 days prior to the effective date of the change(s), or as otherwise provided by law.

Cross-Border and Foreign Currency Transaction Fees and Exchange Rates

When you use your Card to make a purchase or ATM withdrawal outside of the United States, a Cross-Border Fee of up to 1.8% of the transaction amount will be assessed. Purchases outside the United States also include Internet transactions made when you are in the United States, but the merchant processes the transaction in a foreign country. When you use your Card at a merchant that settles in a currency other than U.S. dollars, an additional Currency Conversion Fee of 0.20% will be assessed for performing the conversion service. Either a government-mandated exchange rate or a wholesale exchange rate selected by Mastercard® will be used for the currency conversation services. The exchange rate Mastercard uses for a particular transaction is the rate Mastercard selects for the applicable currency on the day the transaction is processed, which may differ from the exchange rate applicable to the date the transaction occurred or the date it is posted to your Account. All fees are assessed by Mastercard International Incorporated and SchoolsFirst FCU and will be charged to the Cardholder.

Important Safety Tips When Using an ATM/POS Terminal

  • Be aware of your surroundings and look for well-lit ATMs.
  • Have your transactions ready. Sign checks and total your deposit before approaching an ATM.
  • Stand close to the terminal so that someone near you cannot see your PIN.
  • Immediately put your cash in your wallet or purse. Count it while in the safety of your car or home.
  • Have your Card in-hand before leaving your car.
  • When possible, have another person with you when you use an ATM.
  • Do not use the ATM if you notice anything suspicious in the area.
  • If, while transacting business at an ATM, you notice anything suspicious, cancel the transaction and put your ATM Card away immediately.
  • Never give your Card number, PIN or Social Security number to anyone over email, text message, or phone unless you initiated the conversation.
  • Do not write your PIN on your Card or keep your PIN in the same location as your Card.
  • Do not use a PIN that could be easily identified, such as your birth date, 1111 or 9999.
  • Report all crimes to the ATM owner or operator, SchoolsFirst FCU and local law enforcement officials.
